How is overtime pay calculated?

Multiply your hourly rate by 1.5 to get your overtime rate, then multiply that by your overtime hours. At $18.50 an hour the overtime rate is $27.75, so 2.5 overtime hours pay $69.38.

Under US federal law, overtime hours are the hours over 40 in a workweek, and each week is counted on its own. Some states, such as California, also count overtime by the day.

When overtime is owed

Federal law says covered workers are paid at least one and a half times their regular rate for every hour over 40 in a workweek. Working nights, weekends or holidays is not overtime by itself; what counts is going past 40 in the week.

  • Each week is counted on its own. Two weeks cannot be averaged.
  • Double time is not required by federal law. Some states and some contracts require it.
  • Some states, such as California, also count overtime by the day. For that, use the time card calculator, which has California's rule.
  • If you earn tips, commissions or bonuses, your regular rate for overtime can be higher than your hourly wage.

If your pay looks short

Keep your own record of your hours: this page, a photo of the schedule, a note on your phone. Compare it with your pay stub, then ask whoever does payroll to show you the hours they counted. Honest mistakes get fixed that way.

If that does not work, the Wage and Hour Division of the US Department of Labor takes complaints from workers. The call is free, complaints are confidential, you can speak Spanish, and the division enforces the law without regard to your immigration status.
