How is overtime calculated in California?

California pays one and a half times your regular rate for hours over 8 in a workday, up to 12, and for the first 8 hours on the seventh day in a row that you work in a workweek. It pays double for hours over 12 in a workday and for hours over 8 on that seventh day.

Hours over 40 in a workweek are also paid at one and a half times. An hour is only counted once: if it is already daily overtime, it does not count again toward the weekly 40.

Some jobs are exempt and some have special rules, including farm work and alternative workweek schedules of four 10-hour days.

In the five 9-hour days, the ninth hour of each day is already daily overtime, so 40 regular hours are left and the week adds no more.

Consecutive days: the seventh-day rule

If you work all seven days of one workweek, the seventh day is different: its first 8 hours are paid at one and a half times, and everything over 8 is paid at double.

What counts is your employer's workweek, which can start on any day. Seven days in a row that fall across two workweeks do not trigger this rule. The calculator applies it when all seven days of the week you enter have hours, so set the first day to the day your employer's week starts.

Regular rate of pay

Overtime is worked out on your regular rate, which is what you normally earn for your work. If you are paid by the hour, it is that amount plus the hourly value of other pay you have earned, such as shift differentials. Commissions and piecework count too. It can never be less than the minimum wage.

If you are paid two different rates in the same week, the regular rate is the weighted average: your earnings for the week divided by the hours you worked. The calculator uses one rate, so with two rates work out that average first.

Meal and rest breaks in California

  • Meal break: at least 30 minutes when you work more than 5 hours. If your day is no more than 6 hours, you and your employer can agree to skip it. Working more than 10 hours brings a second meal break.
  • It only comes off if you are free. If you are not relieved of all duty for the 30 minutes, that meal counts as time worked and is paid. In the calculator, do not enter it as a break.
  • Paid rest breaks: 10 minutes for every 4 hours worked or major part of 4 hours. They are paid time: do not take them off.
  • If you do not get them: the employer owes one extra hour of pay at your regular rate for each workday without the meal break, and another for each workday without the rest breaks. That extra hour does not count as an hour worked for overtime, and the calculator does not add it.

If your pay looks short

Keep your own record of your hours: this page, a photo of the schedule, a note on your phone. Compare it with your pay stub, then ask whoever does payroll to show you the hours they counted. Honest mistakes get fixed that way.
